How I handle information when you visit artofspiritmagic.com.

By using this website you agree to the practices described here. If you do not agree, please do not use the website.

1. Controller

The controller responsible for this website is Sascha Herpich, c/o Block Services, Stuttgarter Str. 106, 70736 Fellbach, Germany. Email: artofspiritmagic@online.de. You can also reach me through the contact function of my Etsy shop. Further details are in the Imprint.

2. What this website is

artofspiritmagic.com presents a selection of my digital artworks. I do not sell anything on this website. There is no shop, no checkout and no user account. Purchases are made only on Etsy (artofspiritmagic.etsy.com), where Etsy’s own terms and privacy policy apply.

3. Information I process

Server log data. When you visit the website, my web server and its security tools automatically record technical information: your IP address, the date and time of the request, the page or file requested, the amount of data sent, the referring page, and your browser type, version and operating system. This is technically necessary to deliver the website and keep it secure. The legal basis is my legitimate interest in a stable and secure website (Art. 6(1)(f) GDPR). Server logs are kept only for a limited period and are then deleted or anonymised.

Contact form and email. If you use the contact form or write to me by email, I receive your name, email address, subject and message, together with any other information you choose to send. I use it only to answer your request. The legal basis is Art. 6(1)(b) GDPR (if your request relates to a purchase or a contract) or Art. 6(1)(f) GDPR (other enquiries). I delete the correspondence once your request is dealt with, unless I am legally required to keep it.

Cookies. This website may use cookies and similar technologies that are necessary for it to work, to keep it secure, to speed up page loading (caching) and, where I enable them and where you have given your consent, to understand how visitors use the website. You can control or delete cookies through your browser settings. Blocking some cookies may affect how the website works. I do not use cookies for advertising.

4. Hosting

The website is hosted by a web hosting provider that processes the data described above on my behalf, on the basis of a data processing agreement (Art. 28 GDPR). The provider has access to server log data only to the extent needed to run the hosting service.

5. Analytics

I may use analytics services such as Google Analytics or Google Search Console (for example through the Site Kit plugin) to learn how visitors find and use the website. These services may collect information such as your IP address and browsing activity through cookies or similar technologies, and are subject to the privacy policies of their providers. Where the law requires it, I will ask for your consent before such a service is activated. I do not currently use a newsletter service.

6. Links to other websites

This website contains links to third-party platforms, including Etsy, Pinterest, Instagram, TikTok and Facebook. When you follow a link, you leave my website and the privacy policy of that platform applies. I have no influence over how those platforms process your data.

7. International transfers

The website and my service providers, such as Google if analytics are enabled, may be located in, or process information in, countries outside the European Economic Area. Where this happens, I rely on appropriate safeguards, such as the EU standard contractual clauses or an adequacy decision of the European Commission. By using the website you understand that your information may be transferred to and processed in those countries.

8. Sharing of information

I do not sell your personal information. I pass it on only to service providers that help me run the website (such as the hosting provider), and to authorities where I am legally required to do so.

9. Your rights

You have the right to access the personal data I hold about you, to have it corrected or deleted, to restrict its processing, to receive it in a portable format, and to object to processing that is based on my legitimate interest (Art. 15–21 GDPR). To exercise these rights, please email me. You also have the right to lodge a complaint with a data protection supervisory authority. For me, this is the State Commissioner for Data Protection and Freedom of Information of Baden-Württemberg (Der Landesbeauftragte für den Datenschutz und die Informationsfreiheit Baden-Württemberg).

10. Security

The website is delivered over an encrypted connection (HTTPS). I take reasonable technical and organisational measures to protect information against loss, misuse and unauthorised access. No transmission over the internet is completely secure, however, and I cannot guarantee absolute security.

11. Children

This website is not directed at children, and I do not knowingly collect personal information from them. If you believe a child has sent me personal information, please contact me and I will delete it.

12. Changes to this policy

I may update this Privacy Policy from time to time, for example when the website or the law changes. The current version is always the one published on this page.
