1. Copyright ownership

The artworks, mockups, texts, graphics, logos and branding on this website are created or compiled by Sascha Herpich, as named in the Imprint, unless a different author is expressly stated. All rights that exist in this content are reserved to me to the fullest extent the law allows.

The artworks are created with AI-assisted tools under my creative direction, then hand-selected and upscaled by me. The mockups and room scenes show the artworks in example settings and are for preview only.

2. Protected content

all artworks, images and artwork files, in every size and resolution;
mockups, room scenes, previews and other presentation graphics;
the “Mystical Phoenix” logo, the name “Art of Spirit Magic” and the visual branding;
texts, titles, descriptions, layout and design of this website.

3. What you may do

Without asking for permission you may:

view the website and the artworks for personal, non-commercial purposes;
share links to this website and to my Etsy shop and social media profiles;
quote short excerpts of my texts for news, review or commentary, provided that you credit the source and link back to this website.

If you buy a digital file on Etsy (artofspiritmagic.etsy.com), you may use it for personal purposes, for example as a phone or desktop wallpaper, as a print for your own home, or as inspiration for journals and moodboards. The terms stated in the listing apply.

4. What requires written permission

Except as stated above, none of my content may be used without my prior written permission. In particular, it is not permitted to:

copy, download, reproduce or store the artworks or other content from this website, except as the law expressly allows;
resell, share, distribute, upload or otherwise make the files or images available to others, in any form and on any platform;
use the artworks commercially, for example on products for sale (print on demand, merchandise, stock images), in advertising, or in paid or monetised content;
edit, adapt, remix or create derivative works from the artworks;
use my name, logo or artwork in a way that suggests a connection with, or endorsement by, me;
remove or obscure any copyright notice, credit or watermark.

Uses that the law expressly permits without the rightsholder’s consent remain unaffected.

5. Automated use, text and data mining, and AI training

I expressly reserve all rights in the content of this website. Without my prior written permission, it is not permitted to use this content, in whole or in part, for text and data mining, for scraping or bulk downloading, or to train, fine-tune, test or benchmark any artificial intelligence or machine learning model, including models that generate images, audio or text. Technical measures to detect and block such use may be applied.

6. Requesting permission or a licence

If you would like to use my artwork for a project, a publication or a commercial purpose, please ask first. Send an email to artofspiritmagic@online.de and tell me:

which artwork you would like to use and in which form;
where, how and for how long it would be used;
whether the use is commercial, and who the user or publisher is.

Permission is only valid if I give it in writing. I may grant or refuse permission at my discretion and may attach conditions or fees. A permission for one use does not extend to any other use.

7. Credit

Where I grant permission to use my content, the credit “Art of Spirit Magic” or the credit stated in the permission must be shown.

8. Third-party names and trademarks

The names, logos and trademarks of platforms and social networks mentioned on this website, such as Etsy, Pinterest, Instagram, TikTok and Facebook, belong to their respective owners. They are mentioned only to help visitors find my work, and this does not imply any sponsorship or endorsement. This website is not affiliated with these companies.

9. Infringement

Unauthorised copying, publication, distribution or other use of my content may violate copyright law and can lead to removal of the content, claims for damages and other legal action, without further notice.

Include a description of the material, where it can be found, and your contact details. I will review every notice promptly.
